These Terms and Conditions (“Terms”) govern your use of this website and any purchase of goods or services from us. By placing an order, booking a repair, or using this website, you agree to be bound by these Terms. Please read them carefully before ordering.
1. About Us
Fried Circuits is a trading name of Yuniq Technologies Pty Ltd (ABN 69 688 993 053) (“we”, “us”, “our”). Our showroom and warehouse is at 2/219 Albert Road, Warragul VIC 3820. “You” or “your” means the person or business placing an order, booking a repair, or using this website.
2. Orders and Acceptance
- Placing an order or booking a repair through this website is an offer by you to purchase goods or services, which we may accept or decline.
- A binding contract is formed only when we confirm your order or repair booking (for example, by confirmation email), not simply when you submit it.
- We may decline or cancel an order or booking — for example, if we’re unable to source a required part, if there’s a pricing or listing error, or if a device or project falls outside what we’re able to safely or reasonably work on. If we do, we’ll let you know and refund any amount you’ve already paid for it.
3. Pricing and Payment
- All prices are shown in Australian Dollars (AUD) and include GST unless stated otherwise.
- Repair and custom work quotes are based on the fault or brief described or diagnosed at the time of quoting — see section 4.2 below regarding faults found once work begins.
- Payment for shop goods is generally required at the time of ordering; payment for repair or custom work is generally due on completion, unless we’ve agreed otherwise with you in writing. Payments are processed securely; we don’t store your full card details.
- If a pricing error occurs (for example, due to a technical fault), we may cancel or correct the affected order and will refund any amount you’ve paid for it.
4. Repairs and Custom Electronics Work
Many of the services we provide are custom to your device or project — a repair, modification or bespoke build carried out to your specific request. Because this work is tailored to you, the following additional terms apply.
4.1 Backing up your data
You are responsible for backing up any data, settings or accounts on your device before giving it to us for repair, modification or servicing. While we take reasonable care, we are not responsible for any loss of data, software or account access that may occur during diagnosis, repair or servicing.
4.2 Diagnosis and additional faults
A repair quote is based on the fault(s) described or diagnosed at intake. Further faults are sometimes discovered once a device is opened or repair work begins; if this happens, we’ll contact you with an updated quote before carrying out any additional work. If, after inspection, you decide not to proceed with a quoted repair, a diagnostic or assessment fee may apply, as advised to you before we begin assessing your device.
4.3 Parts and pre-existing condition
Repairs may use new, refurbished, remanufactured or compatible third-party replacement parts, as appropriate for your device and repair — we’ll use manufacturer-original parts where reasonably available and unless you’ve asked us to use an alternative. We’ll note the condition and any pre-existing damage or wear of your device at intake; our repair warranty covers the specific fault we repaired and doesn’t cover pre-existing damage, unrelated faults, or damage arising after the device is returned to you.
4.4 Repair warranty
Unless otherwise stated at the time of your repair, we warrant our repair work for 3 months from the date of collection, covering the specific fault we repaired. This warranty doesn’t apply if the device is subsequently opened, modified or repaired by someone else, or is damaged (including by liquid, impact or misuse) after it’s returned to you. This is in addition to, and doesn’t limit, your rights under the Australian Consumer Law described in section 6 below.
4.5 Collecting your device
Please collect your device promptly once we notify you that work is complete. If a device isn’t collected within a reasonable period after we’ve contacted you (including a follow-up reminder), we may charge reasonable storage costs and may deal with the device as uncollected goods in accordance with the Australian Consumer Law and Fair Trading Act 2012 (Vic), which can include selling or disposing of it to recover our reasonable costs.
4.6 No change-of-mind returns on custom work
Because custom builds and modifications are carried out to your specifications, we are not required to, and generally will not, provide a refund simply because you change your mind once work has begun. This does not affect your rights under the Australian Consumer Law described in section 6 below — those rights always apply, including if work is faulty or doesn’t match what was agreed due to an error on our part.
5. Delivery and Shipping
- We ship shop goods Australia-wide; local pickup and drop-off is available from our Warragul warehouse for repairs and custom work.
- Delivery and repair timeframes shown on this website or given at booking are estimates only and are not guaranteed, unless we’ve expressly agreed a fixed date with you in writing.
- Risk in the goods passes to you on delivery. Title (ownership) of any goods sold passes once we’ve received payment in full.
- If a delivery is delayed or lost by a third-party carrier, we’ll work with you and the carrier to resolve it. Our liability is limited as set out in section 9 below, in addition to your rights under the Australian Consumer Law.
6. Australian Consumer Law — Your Guarantees
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded, restricted or modified.
Under the ACL, goods and services we supply come with guarantees that cannot be excluded, including that goods will be of acceptable quality, fit for any disclosed purpose, and match their description; and that services (including repairs) will be provided with due care and skill and be fit for any disclosed purpose. If there is a major failure (for example, the goods or repair are unsafe, substantially unfit for their normal purpose and can’t easily be fixed within a reasonable time, or significantly differ from their description), you can choose a refund, a replacement, or to keep the goods and be compensated for any drop in value — plus compensation for any other reasonably foreseeable loss or damage. For a failure that isn’t major, we may choose to remedy it by repair, replacement or refund, provided we do so within a reasonable time.
To the extent permitted by law, and subject to the guarantees above, our liability for a failure to comply with a consumer guarantee in relation to goods or services that are not of a kind ordinarily acquired for personal, domestic or household use or consumption is limited, at our option, to one or more of: replacing the goods or supplying equivalent goods; repairing the goods; paying the cost of replacing the goods or acquiring equivalent goods; paying the cost of having the goods repaired; or, for services, supplying the services again or paying the cost of having the services supplied again.
7. Returns, Refunds and Repairs
- If you believe your goods or repair are faulty, not as described, or don’t meet a consumer guarantee, contact us at [email protected] with your order or repair details and a description of the issue — we’ll assess your claim promptly.
- Where the ACL requires a remedy, we’ll arrange a repair, replacement or refund as appropriate at no cost to you.
- We may ask you to return the item or device to us, at our cost where your claim is valid, so we can assess or verify the issue before providing a remedy.
- Outside of your Australian Consumer Law rights, and other than for custom work (see section 4.6), we may at our discretion accept a change-of-mind return within 14 days of delivery for unused shop items in original condition, less any original shipping cost.
8. Cancellations
You may request to cancel an order or repair booking before work has begun for a full refund. Once we’ve begun diagnosing or working on your device or project, cancellation may not be possible, or may incur a charge reflecting work already completed and parts used, which we’ll advise you of before proceeding. We may also cancel an order or booking at any time before completion — for example, if we’re unable to complete it as agreed — in which case we’ll refund any amount you’ve paid for it.
9. Limitation of Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, we exclude all liability for indirect, special or consequential loss arising from your use of this website or our goods or services. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including our liability under the Australian Consumer Law.
10. Intellectual Property
All content on this website, including text, images and logos, is owned by or licensed to us and may not be reproduced without our permission. If you ask us to build or reproduce a design, logo or trade mark as part of a custom project, you must own it or have the right to use and reproduce it, and you agree to compensate us for any claim, loss or cost we reasonably incur as a result of a third party’s rights being infringed by content you’ve asked us to use.
11. Force Majeure
We won’t be liable for any delay or failure to perform our obligations under these Terms where the delay or failure results from circumstances beyond our reasonable control, including natural disasters, supply or parts shortages, transport disruption or industrial action. If this continues for an extended period, either of us may cancel the affected order or booking for a full refund of amounts paid for undelivered goods or unfinished services.
12. Privacy
We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. If you have any questions about how we collect, use or protect your personal information, please contact us using the details below.
13. Complaints
If you have a complaint, please contact us and we’ll aim to resolve it promptly and fairly. If you’re not satisfied with our response, you can contact Consumer Affairs Victoria or the ACCC for guidance on your rights.
14. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time you place an order or book a repair applies to it. Updates will be posted on this page with a revised date.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
